Two finger test which comes in rape cases and also it is the heinous to the victim. This two finger test has now in Supreme Court where Supreme Court has ban this test by 31 oct 2022.

Supreme Court has verdict about it that for the investigation of rape victims to use two finger test is unconstitutional and unscientific that victims faces same type of crime again in investigations.

What is two finger test ?

“It is very shameful that this type of rituals and process to test the virginity and rape investigation still present in our country. Investigation regarding Women’ private is against the dignity of her and this can not be say that A sexual active women can not be rape.  Supreme Court has banned this test in rape investigation and gave instructions to break this law this act will be come under crime. Now the question is that why is it so controversial?

There are two main reason given below.

  1. Some parts of India still are doing this test in the rape case , court has declared it unconstitutional.
  2. This test is totally against of “RIGHT TO PRIVACY and Respect.




Had this test banned earlier?


After Nirbhaya case this test declared as unconstitutional in 2014. Centre government had also said that this is unscientific.Central Health Ministry made a new guidelines to the rape victims in which two finger test was clearly wrong.




Is this test scientific?


Specialist does not say that this is scientific because there can be so many reason to break the Hyman like playing sports, cycling or during medical tests.


UN WOMEN , WHO AND UN HUMAN RIGHTS

To investigate virginity of a girl there is no scientific base in which test can give 100% surety of virginity to declare that she has done sex or no.
